Why are you entitled to money after a cancellation or delay?

EU Regulation 261/2004 / EC provides that passengers affected by a cancellation are entitled to a flat-rate compensation payment by the airline.

Switzerland has also adopted this regulation. Thus, this Regulation applies to each flight:

  • that would have started in the EU / Switzerland
  • landed in the EU / Switzerland and operated by an EU / CH airline
  • further, the event that led to the cancellation must have been within the power of the airline to avoid.

The abovementioned Regulation does not provide for compensation in the event of delays. However, as a result of an ECJ ruling, affected passengers are still entitled to compensation if a flight arrives at its destination airport at least 3 hours late. As ECJ rulings are not binding in Switzerland, delayed flights can only be checked if at least one affected airport is located in the EU (for example, on a flight from Zurich to Berlin).
